| This License Agreement is a legal contract between you (either as an individual
or as an entity) and Colasoft Co., Ltd. ("COLASOFT") for the products Colasoft
MAC Scanner, Colasoft Ping Tool, Colasoft Packet Builder and Colasoft Packet
Player ("SOFTWARE PRODUCTS").
You should
carefully read the following terms and conditions before using the Software
Products. Installation or use of the SOFTWARE PRODUCTS indicate your
acceptance of this License Agreement. If you do not agree with the
following, do not use the SOFTWARE PRODUCTS and remove them from your storages.
Copyright
The SOFTWARE PRODUCTS and Documentations are copyrighted by COLASOFT and are
protected by international copyright laws. The SOFTWARE PRODUCTS contains
copyrighted software of COLASOFT. All rights reserved. You agree not to remove
any trademarks or copyright notices from the SOFTWARE PRODUCTS and Documentations.
Free License
You may use the free version of the SOFTWARE PRODUCTS free for personal and
educational use but NOT for commercial use. For commercial use, you need to buy
a "Commercial License".
However, media costs associated with the distribution of the SOFTWARE PRODUCTS
may be recovered. You shall use your best efforts to promptly notify COLASOFT
upon learning of any violation of commercial restrictions.
You are allowed to distribute the free version of the SOFTWARE PRODUCTS complete
of all files to others. You are not allowed to add, remove or change any of
these files. The SOFTWARE PRODUCTS and the attached documentations can not be
distributed together with commercial software. For this you need to purchase a
"Commercial License" from COLASOFT.
By using the free version of the SOFTWARE PRODUCTS you may not claim for product
support by the manufacturer. Anyway, the manufacturer will make an effort to
answer support requests. Product support will be provided via e-mail. Before
transmitting your support request please read our hints. Probably you will be
able to find a solution to your problem and you don't need to contact us. Very
important is that you indicate the correct version of the SOFTWAREs and the used programming language.
Commercial License
If you are not a personal or educational user you should purchase for a
commercial license from COLASOFT.
With a commercial license means that COLASOFT grants you a non-exclusive,
non-transferable permit to use one copy of SOFTWARE PRODUCTS subject to the
terms and conditions of this License Agreement. The SOFTWARE PRODUCTS is
licensed, not sold.
COLASOFT may terminate this License Agreement if Licensee breaches any of the
terms and conditions. In the event of such termination and upon expiry of the
license granted herein, Licensee will delete the SOFTWARE PRODUCTS from any files
and data storage. All provisions of this License Agreement relating to
disclaimer of warranties, limitations of liability, remedies, or damages, and COLASOFT's proprietary rights shall survive termination.
Save to the extent expressly permitted by this License Agreement or mandatory
provisions of law, Licensee shall not modify, translate, reverse engineer,
decompile or disassemble the SOFTWARE PRODUCTS or any part thereof.
In no case shall the Licensee distribute any components or files provided with
the SOFTWARE PRODUCTS package. In no case may the license key file be
distributed. The licensee is to store the license keys and files supplied by
COLASOFT in a safe place. COLASOFT is not responsible for lost license keys or
files and cannot issue new keys or files to replace lost keys or files.
The licensee is required to hold the license keys and files secure. The licensee
will be held responsible for any unauthorized use of the license keys or files.
The licensee agrees not to attempt to bypass the license mechanism or generate
unauthorized license keys or files.
Disclaimer
THE SOFTWARE PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER
EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL COLASOFT.
BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING INCIDENTAL OR CONSEQUENTIAL DAMAGES,
ARISING OUT OF THE USE OF THIS SOFTWARE PRODUCT, EVEN IF ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LICENSE,
UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS.
Governing Law
This Agreement will be governed by the laws of the People's Republic of China
and International Intellectual Property Protection Treaties.
Other Restrictions
COLASOFT, in its sole and absolute discretion, may have included a portion of
the source code or online documentation of the SOFTWARE PRODUCTS. Except for any
such portions, you shall not REVERSE ENGINEER, DECOMPILE, DISASSEMBLE, OR
OTHERWISE REDUCE ANY PORTION OF THE SOFTWARE PRODUCTS TO ANY HUMAN PERCEIVABLE
FORM, except to the extent this restriction is prohibited by applicable law.
