This Download License Agreement is not a sales contract but an agreement between Colasoft and you regarding the use of Colasoft's software (Software). Installing Software implies that you agree to the terms of this agreement. If you disagree with any part of this agreement, you must return Software along with your sales receipt to your reseller without breaking the seal on the CD-ROM.
1. Right of Use
Colasoft grants you the right to use Software in accordance with the terms of this agreement. You may install and operate Software on your computer system. You may not save any of the installation files of Software on your network or file server for the purposes of performing additional installations using these copies. When our software is stored in your system's main memory or other storage device, it is assumed that you are using Software and Software has been installed from the original media. If Software is installed on a network server, you must purchase a quantity of license equal to the number of users. You may not give your serial number or license key to any other person.
2. Transfer of Right to Use
If you upgrade Software, your right to use the original version is transferred to the new version. This right is based on the condition that you are not using both versions simultaneously. In addition, you may not transfer, lend or sell the old version to another person. If any software not owned by Colasoft was provided with the old version, you retain the right to use these additions after the upgrade.
3. Copyright
The copyright and intellectual property rights of Software and its documentation and packaging belong to Colasoft and are protected by International Intellectual Property Protection Treaties and the related laws of China. Therefore, you may not copy any portion of Software in any form, except to use Software in accordance with the terms of this agreement or to make one copy for backup purpose. You may not alter Software in any way. If copies of the documentation must be made, you should make them in printed form only.
4. Limitation of Warranties
Colasoft warrants that all the contents of the package, including the CD-ROM, are free of physical defects for 30 days from the date of purchase. If defects are found, and proved to have been caused in the course of production, Colasoft will replace Software for you. To be eligible for a replacement, you must prove that the 30 day warranty period has not expired. If damage has resulted from abuse or incorrect installation or use by you, Colasoft is not responsible for replacement. Colasoft does not warrant that using Software will fit a user's particular purpose and is not liable for any damages caused by the use of Software.
5. Acknowledgement
You acknowledge that you have read and fully understood the download license agreement and agree to all the terms. You acknowledge that this agreement has priority over any order, engagement, advertisement or any other written agreement which preceded it.
